What Is a Power of Attorney — and Why Does It Need a Notary?
A Power of Attorney (POA) is a legal document that grants one person — called the agent or attorney-in-fact — the authority to act on behalf of another person (the principal) in financial, legal, or medical matters.
In Washington State, a Durable Power of Attorney must be notarized to be legally valid. Without a notary’s acknowledgment, banks, financial institutions, and courts may refuse to honor the document.

Durable POA (Financial)

POA Notarization Requirements in Washington State
Under RCW 11.125 (Washington’s Uniform Power of Attorney Act), a Power of Attorney must be signed by the principal and acknowledged before a notary public to be legally effective for most purposes.
Important: Washington State requires an Acknowledgment notarial act for the principal signing a POA — not a Jurat. The notary verifies identity, witnesses the acknowledgment, and affixes their seal and signature.

The principal must present a current government-issued photo ID — driver’s license, passport, military ID, or tribal ID.
Acknowledgment Act
The notary performs an Acknowledgment — verifying the signer appeared voluntarily and signed of their own free will.

Washington State does not require witnesses for a standard Durable Power of Attorney — only notarization of the principal’s signature. However, some POA documents drafted by attorneys may include witness lines. Always follow the instructions in your specific document.

A current, government-issued photo ID — such as a Washington driver’s license, passport, military ID, or tribal ID. If the signer has no ID, a credible witness who personally knows the signer may be used as an alternative under Washington notary law.
Washington State caps notarial act fees at $15 per signer, per document. A travel fee also applies based on time of day and day of week. Standard weekday appointments start at $55 travel + $15 per act. Evening and weekend rates are higher.
The principal must be mentally competent at the time of signing. If there is any question about capacity, we may need to pause and defer to an attorney or physician before proceeding.
For a standard Washington State Durable POA, witnesses are not required. If your document has witness lines, you will need to arrange witnesses — we cannot serve as a witness for documents we are notarizing.
