Terms of Service

These Terms of Service are a legally binding agreement between you (personally or on behalf of an entity) and
Clark County Mobile Notary, operated by LuxeMynt LLC ("we", "us", "our").
By requesting, booking, or using our services, you agree to these Terms.
1. Agreement to Terms
You confirm that you have read and understood these Terms, and you agree to follow them when you schedule an appointment, communicate with our team, or receive services through our network.
2. Nature of Services (Scheduling and Dispatch)
Please read carefully: Clark County Mobile Notary operates primarily as a scheduling and dispatch service.
- Independent contractors: The Notary Public or Field Agent assigned to your request is an independent contractor and not an employee of LuxeMynt LLC.
- Network standards: We require contractors in our network to provide proof of an active Notary commission (when applicable), periodic background screening, and Errors and Omissions (E and O) insurance.
- Responsibility for the notarial act: The assigned Notary Public is responsible for the notarial act they perform. Questions or claims about a notarization must be directed to the Notary Public who completed the appointment.
3. Field Inspection and Property Check Services
If you engage us for Property Checks, Occupancy Verification, or Commercial Field Inspections, the following terms apply:
- Visual observations only: We report factual, visible conditions at a specific moment in time. We are not licensed home inspectors, engineers, or appraisers.
- Not a notarial act: Property checks are private services and are not notarial acts regulated by the State of Washington.
- Access and trespass: We do not force entry. Unless you arrange lawful access in advance, inspections are limited to exterior, street view, and publicly accessible areas.
- Limitations: LuxeMynt LLC is not liable for conditions that were not visible at the time of the visit.
4. No Legal Advice
Important notice: Neither LuxeMynt LLC nor its independent contractors provide legal advice.
- We cannot explain the legal meaning of your documents.
- We cannot advise you whether you should sign.
- We cannot choose the correct notarial certificate for you.
5. Appointments, Cancellations, and Trip Fees
When you book with us, we reserve a dedicated time slot and dispatch an agent to your location. Because we are a mobile service, our fees are structured to cover the costs of logistics and time lost due to last-minute changes.
A. Cancellation Policy
Cancellation & Rescheduling Fees: Please note that these fees apply specifically to the quoted travel fee:
- Notice of 2 to 24 hours: Appointments canceled or rescheduled with less than 24 hours' notice, but more than 2 hours before the scheduled time, will be subject to a cancellation fee equal to 50% of the total quoted travel fee.
- Notice of less than 2 hours: Appointments canceled or rescheduled within 2 hours of the scheduled start time will be charged 100% of the total quoted travel fee.
B. Trip Fees for Incomplete Appointments
Non-Performance & On-Site Fees: If the agent departs for the appointment or arrives on-site and the signing cannot proceed for any of the following reasons, the full travel fee (100%) remains due and non-refundable:
- Identification: The signer does not have a valid, unexpired, government-issued ID.
- Absence: The signer is not physically present at the agreed location.
- Capacity: The signer appears disoriented, medicated, or otherwise lacks the mental capacity to sign.
- Incomplete Documents: The document is incomplete, missing pages, or requires corrections before notarization can occur.
- Refusal: The signer refuses to sign for any reason.
- No-Show: If the client is not present and does not contact us within 15 minutes of the scheduled start time.
6. Identification Requirements
Washington law requires proper identification of signers. Each signer must present an unexpired government-issued ID, such as:
- A US state driver's license or identification card
- A US passport or passport card
- A foreign passport (with applicable US immigration documentation)
- Another government ID that includes a photograph and signature
7. Payment Terms
Payment is due at the time of service unless we approve a written corporate billing arrangement in advance. If payment is not received, the contractor may end the appointment. We may withhold completed documents until payment is received in full.
8. Limitation of Liability
To the fullest extent permitted by Washington law:
- LuxeMynt LLC liability: Our liability is limited to the scheduling or administrative fees paid to us, if any.
- Contractor liability: Any claim arising from the notarial act is the responsibility of the independent contractor and their insurance provider.
9. Governing Law and Venue
These Terms are governed by the laws of the State of Washington. Any dispute related to these Terms will be brought in the courts located in Clark County, Washington.
